BOUNDARIESI don’t mind inspiration! For characters designed by others, you should abide by their TOS/boundaries. For my designs, again, follow the TOS / boundaries of whoever owns them. Otherwise, if you’re all clear, I really don’t care if you colorpick or get inspired as long as it’s distinguishable from my own characters. Unsure if it’s too similar? I am primarily an animal / anthro artist (with some humans as well!) I have OCD/pretty bad anxiety when it comes to stuff like attention, so I try to keep my online presence low-key to not stress myself out.
That said, I don't bite, so if you want to reach out, feel free! A little bit more about me as a person:I'm a college student in a STEM field, with an interest in weather. I do art as a hobby on the side, and I really love collecting characters. I don't have a preference on how I am referred to (so any pronouns or terms are fine). My art and characters may reflect my real world experiences with identity or OCD, so viewer discretion is advised. My work may also include horror, blood, or other dark topics. They will be appropiately tagged, but please exercise caution. I do not produce or feature any 18+ / sexual content on my accounts.I don't often involve myself in fandom spaces (as most of my interest lies in my own characters), but I am a pretty big pokemon fan, so there's that? Theres more, but the fixations come and go, haha.I adore all my characters a ton, even if I dont always have the time to draw them or ability to commission stuff for them. Even if I havent gotten to drawing them, I do think of them all the time.

ART TOS
I retain some rights to my art as the creator.- Refusal: I reserve the right to refuse any commission / request if I'd so choose, and a right to terminate a commission (with a full refund) if necessary.- Usage: You may not claim my work as your own. If you were NOT the commissioner of my work, you may not repost it or use it. If you have commissioned the work in question from me, you may repost it or use it as profile pictures, backgrounds, banners, etc, essentially in any non-profit way you see fit*. However, you must credit my work in some way if you intend to use it in the cases above.
*AI use involving my work is strictly prohibited. You may not use my art in illegal or hateful ways regardless of it you commissioned it or not. You may not remove my signature or watermark.-Commercial Use: You cannot use my work, commissioned or not, in commercial or otherwise profitable use without a commercial use license agreement. This includes, but is not limited to: merchandise (personal/for you only is excluded), studio projects, etc. A commercial use license can be purchased for my work with specific terms that must be agreed upon by at least both I, the seller, and you, the commissioner / interested party. Contact me privately to discuss details if you'd wish to obtain one. Payment ranges from a one-time fee to royalties depending on the size of the project.- Posting to Social Media: I retain the right to share any finished commission work I do, including posting on social media or using as an example / in my portfolio. If you wish for your commission to remain private, you must discuss this with me during the commission process.- Refunds: Refunds are case by case basis. In most cases, you can be refunded a portion of the original payment depending on completion status of the commission (with full refunds if I have not started.) However, in the case of wanting a refund on a completed piece, you may not inherently be entitled to any refund. If I need to cancel a commission for any reason, you will be provided a full refund.- If you have any concerns about art I have created, do not hesitate to contact me to resolve it.Failure to abide by these rules will lead to a refusal to do further business and a possible block. Unlicensed sale of my work or usage of it in a harmful manner may result in legal action.
PAYMENT
- I take payment through paypal, venmo, or cashapp. I do not accept any other methods, except for possibly Ko-Fi.- Payment is not to be made until an agreement is reached about a deal- Payment is either upfront or half and half.- I do not accept checks of any kind.- unwarranted / scam chargebacks will result in a block, possible psa, and the design/art product revoked.Please PLEASE reach out to me if you have any issues. I am always willing to talk things through and reach an agreement.
BASE / DESIGN TOS
Base TOS- I must be credited for use of a base. Signature is not to be removed.- I retain some rights to the base as the creatorYOU MAY:- Use for personal use, adopts, design commissions, etc.- Edit bases (as long as credit remains to me)YOU MAY NOT:- Use to gain monetary value (non-design commissions (if they are F2U), reselling/redistributing, etc)- Remove credit- Trace and/or pass off as your ownDesign TOSUpon obtaining a design by me, you are free to do what you please with it, except for commercial use, in which you’ll need a license from me directly (refer to my art TOS.)revocation only happens in the event of a scam/unfair chargeback. I will not revoke designs under any other circumstance. below is a list of things i’d prefer / not prefer to see done with my designs, but ultimately i will not enforce these beyond blocking / blacklisting from obtaining other designs, or resolving any theft cases.———-Resale: try not to sell a design for more than it’s worth. any commissioned art or art you’ve made yourself may add to their worth. you may sell a design that was traded to you / given to you through art as long as it lines up with their worth. Ask me if you’re not sure. If you have an emergency and need to sell them for more, you may do so.- Usage: please don’t use my designs for illegal / hateful works or promotions, such as zoo/pedo support, fascist ideology, etc.- Editing: you may edit my art / designs as you wish, you don’t have to ask. just ensure to credit me for the originals. try to keep an unedited copy around in case you trade/sell the character in the future.- Inspiration: it will depend on the current owner of the character if you can take direct inspiration / color pick from said design. for my designs that i currently own, i don’t personally mind if you take inspiration or colorpick or whatnot, but someone else who owns my design might, so be sure to ask them. be sure not to completely copy / steal any designs, however.-Ownership Disputes: Do not involve me in co-ownership disputes, only involve me if it’s a case of theft. I do not mind if you co-own or not. One profile per character is preferred. If they’re disputes about ownership, you must resolve it yourselves. If it is a case of theft, you may contact me to help resolve it. It is recommended you contact the admins over me, however.-Offsite Sale: If you plan to sell offsite [toyhouse], contact me first. I have a ton of codes i can give for the buyer to use. I will not allow an offsite sale if the buyer does not agree to create an account to house the character or otherwise find other methods to keep me updated on ownership. This is to prevent theft / be able to verify ownership in the event something happens and I need to confirm who currently, actually owns the character.-Privatization: You may private / hide profiles, but don’t delete them. Same reasoning as above, I need to be able to verify ownership if something happens. I do not mind if you private or hide your character, however. You don’t have to auth me or give me a key if you’re not comfortable with it. If you no longer have access to a toyhouse account a character is on and wish to sell them, refer to offsite sales above. I am contactable as tempawture basically everywhere else.Do not hesitate to reach out with questions!! I will be happy to answer them!
